Following a pursuit, officers were able to detain him. While placing him under arrest a woman that was traveling with Garay, later identified as 28-year old Christine Baca, attempted to push arresting officers off of Garay.

Beca was charged with Obstructing Governmental Administration in the 2nd degree. Garay was charged with Resisting Arrest, Obstructing Governmental Administration in the 2nd degree, and the original felony robbery warrant.
