Buffalo, NY (WNY News Now) – A 43-year-old man faces face a Manslaughter charge for the alleged shooting of a cyclist with a BB gun, resulting in the victim’s death.
Erie County District Attorney John J. Flynn revealed that Kenneth James, 43, of Lockport, was arraigned this morning before Buffalo City Court Judge Rebecca Town on a single count of Manslaughter in the First Degree, categorized as a Class “B” violent felony.
The incident is said to have occurred on August 14, 2023, at approximately 3:50 p.m. According to the allegations, James intentionally discharged a BB gun at the victim with the intent to inflict serious physical harm. The incident unfolded as the victim, a 38-year-old male, was riding a bicycle along Broadway near Krettner Street in the City of Buffalo. The victim succumbed to his injuries at the scene of the crime.
James is scheduled to return on Wednesday, August 23, 2023 at 9:30 a.m. for a felony hearing. He was held without bail.
