(WNY News Now) – A 43-year-old Lockport resident, was arraigned today on charges of Manslaughter and Criminal Possession of a Weapon for fatally shooting a bicyclist with an air gun in Buffalo.

Buffalo – Erie County District Attorney John J. Flynn has announced Kenneth James’ indictment for the death of 38-year-old Joseph Dash. On August 14, 2023, at 3:50 p.m., James allegedly shot Dash with an air gun with the intent to cause severe injury while he was cycling on Broadway near Krettner Street in Buffalo. Dash tragically died at the scene, with an autopsy confirming the cause of death as a pellet round to the chest.

James faces charges of Manslaughter in the First Degree, Manslaughter in the Second Degree, and Criminal Possession of a Weapon in the Third Degree. His pre-trial conference is set for October 12, 2023, with bail at $250,000 cash or bond. If convicted, James could be sentenced to a maximum of 25 years in prison.
