(WNY News Now) – BUFFALO, N.Y.-U.S. Attorney Trini E. Ross announced today that a federal grand jury has returned an indictment charging a 23-year-old man from Buffalo, NY, with distribution of controlled substances causing death and trafficking in counterfeit drugs causing death. The charges carry a mandatory minimum penalty of 20 years in prison and a maximum of life.
Assistant U.S. Attorney Joshua A. Violanti, who is handling the case, stated that according to the indictment, on December 2, 2022, Javonte Holloway distributed fentanyl, which caused the death of a toddler. In addition, Holloway sold counterfeit M-30 oxycodone hydrochloride pills containing fentanyl and acetyl fentanyl.
The indictment is the result of an investigation by the Drug Enforcement Administration, under the direction of Special Agent-in-Charge Frank A. Tarentino, III, New York Field Division, the Niagara County Sheriff’s Office, and the Niagara County Drug Task Force, under the direction of Sheriff Michael Filicetti, and the Lockport Police Department, under the direction of Chief Steven Abbott.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
