(WNY News Now) – Buffalo – Erie County Court has sentenced Timothy M. Wagner to probation and community service for a hit-and-run incident involving a pedestrian in the Town of Cheektowaga.

Timothy M. Wagner, 29, of Buffalo, was sentenced to one year of probation and 100 hours of community service for injuring a pedestrian in a hit-and-run accident, announced Acting Erie County District Attorney Michael J. Keane. Erie County Court Judge Sheila A. DiTullio delivered the sentence.

The incident occurred on April 19, 2021, at approximately 7:50 a.m. Wagner was driving a pickup truck eastbound on Losson Road in Cheektowaga when he veered onto the shoulder and struck a pedestrian near Wedgewood Drive. The 60-year-old victim from Depew was hit from behind, forcing him facedown onto the ground. Wagner left the scene without reporting the incident. Later that day, Cheektowaga Police found Wagner’s vehicle with front-end damage matching witness descriptions.

The victim, a 60-year-old man from Depew, was taken to the hospital. He underwent multiple surgeries for physical injuries. The victim consented to the plea to a reduced charge, resulting in Wagner pleading guilty to one count of Reckless Driving, an unclassified misdemeanor under New York State Vehicle and Traffic Law, on March 4, 2024. Wagner’s plea came on the day jury selection was set to begin for his trial.

Acting DA Keane commended the Cheektowaga Police Department Traffic Unit for their diligent investigation. The case was prosecuted by Chief Paul J. Glascott of the Vehicular Crimes Bureau and Assistant District Attorney Thomas J. Comfort of the Felony Trials Bureau.
