(WNY News Now) – Little Valley – In a late-night incident, an Olean man was arrested for aggravated DWI after allegedly registering a BAC over three times the legal limit.
Sheriff Timothy S. Whitcomb reported that on June 26, 2024, at approximately 1:36 AM, Daniel E. Dailey, 27, of Olean, NY, was arrested for driving while intoxicated during a traffic stop on Rock City Street in Little Valley.
Following an investigation, Dailey was transported to the Cattaraugus County Sheriff’s Office for processing, where a chemical test on the Datamaster device indicated a blood alcohol concentration of 0.25%. This result is over three times the legal limit of 0.08% for drivers in New York State.
Dailey has been charged with multiple violations, including aggravated driving while intoxicated under New York State Vehicle and Traffic Law (NYS VTL 1192-2aa), common law DWI (NYS VTL 1192-3), and other related offenses. He was issued an appearance ticket and multiple uniform traffic tickets for charges such as:
- Aggravated DWI (NYS VTL 1192-2aa)
- Common Law DWI (NYS VTL 1192-3)
- Driving While Intoxicated (NYS VTL 1192-2)
- Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree (NYS VTL 511-3a1)
- Operating Without Insurance (NYS VTL 319-1u)
- Consumption of Alcohol in a Motor Vehicle (NYS VTL 1227-1)
- Obstructing Governmental Administration (NYS PL 195.05)
Dailey is scheduled to appear in the Town of Little Valley Court at a later date to address these charges. As are all persons accused of a crime, Dailey is presumed innocent until proven guilty in a court of law.
