(WNY News Now) – Buffalo – A Buffalo man faces up to six years in prison after being convicted of stealing materials from a local construction site.

38-year-old Sergio J. Brooks of Buffalo was sentenced to 2 to 6 years in state prison by State Supreme Court Justice M. William Boller. The sentence follows Brooks’ conviction for burglary and grand larceny in connection with a February 2023 theft at a construction site in Buffalo.

On the early morning of February 16, 2023, Brooks unlawfully entered a partially completed building on Best Street near Michigan Avenue. A security system at the site alerted Buffalo Police, who quickly responded and apprehended Brooks nearby. He attempted to flee after dropping two bags filled with stolen construction materials, including pipes, circuit breakers, and copper.

Following a one-day trial in July 2024, a jury deliberated for less than four hours before convicting Brooks of Burglary in the Third Degree and Grand Larceny in the Fourth Degree. The swift decision underscored the clear evidence against him.

Acting Erie County District Attorney Michael J. Keane praised the Buffalo Police Department for their effective response and investigation, which led to the successful prosecution. Assistant District Attorneys Anthony F. Perna and Jia-Chir Chiu managed the case.
