(WNY News Now) – Busti – A Jamestown man with a history of DWI convictions faces felony charges after being arrested for driving while intoxicated during a domestic incident in Busti.

On the evening of August 28, 2024, at approximately 8:03 p.m., officers were dispatched to a domestic incident at 3320 Busti-Stillwater Road. Upon arrival, it was discovered that the suspect, 47-year-old Kenneth L. Drake of Jamestown, had left the scene.

Shortly after, Drake was observed returning to the residence in a red flatbed pickup truck. Officers determined that Drake was intoxicated. A license check revealed that Drake’s driving privileges had been revoked due to five prior DWI incidents and other license suspensions for failing to answer court summonses.

Further investigation showed Drake had seven previous DWI convictions, with the most recent occurring in April 2023. The arrest was elevated to a felony due to his extensive history of alcohol-related driving offenses. Additionally, Drake was in violation of a court-ordered restriction requiring an interlock device on any vehicle he operated, which was not present in the truck he was driving.

Drake was taken into custody and processed before being issued appearance tickets for Felony Aggravated Unlicensed Operation in the 1st Degree, Felony Driving While Intoxicated, and Operating a Motor Vehicle without an Interlock Device. He is scheduled to appear in the Town of Busti Court at a later date. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
