(WNY News Now) – A Knoxville man was arrested in the early hours of Sunday after deputies stopped his vehicle for erratic driving on I-86 in Chautauqua County.

ELLERY, NY – Eric J. Rush, 50, of Knoxville, Tennessee, was arrested on charges of driving while intoxicated and other violations following a traffic stop early Sunday morning on I-86.

Deputies with the Chautauqua County Sheriff’s Office were dispatched to a vehicle complaint on the eastbound lanes of I-86 near the Town of Mina around 4:40 a.m. Upon locating the vehicle in the Town of North Harmony, deputies observed a traffic infraction and initiated a stop in the Town of Ellery.

During the investigation, Rush was found to be operating the vehicle while allegedly under the influence of alcohol. He was charged with driving while intoxicated (DWI), DWI per se (having a blood alcohol content of 0.08% or higher), aggravated unlicensed operation of a motor vehicle in the third degree, and failure to keep right.

Rush was released with citations and is scheduled to appear in Town of Ellery Court on a later date. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
