(WNY News Now) – A Westfield man faces multiple charges, including aggravated DWI, after his vehicle was pulled over for a tail lamp violation on November 23rd, revealing a blood alcohol concentration more than three times the legal limit.
On the evening of November 23, 2024, at approximately 9:41 PM, Westfield Police responded to an incident at 238 E Main St, where they encountered William E. Zachary, who was allegedly intoxicated. The officers were initially speaking with the complainant at a different location when they observed Zachary driving on E Main St without his tail lamps illuminated, a violation of New York State Vehicle and Traffic Law.
A traffic stop was promptly initiated, and Zachary underwent standardized field sobriety tests. After failing the tests, he was arrested and transported to the Chautauqua County Sheriff’s Office for further processing. A subsequent test revealed that his blood alcohol concentration (BAC) was 0.24%, well above the legal limit of 0.08%.
Zachary faces charges for No/Insufficient Tail Lamps, Driving While Intoxicated (DWI), and Aggravated DWI, due to his BAC being over 0.18%. He was issued appearance tickets and is scheduled to appear in Westfield Village Court at a later date.
The investigation was conducted by the Westfield Police Department. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
