(WNY News Now) – Justin L. Davis, 24, of Buffalo, receives maximum sentence for assaulting probation officer during custody at the Erie County Probation Department.

Acting Erie County District Attorney Michael J. Keane announces that Justin L. Davis, 24, of Buffalo, was sentenced this morning before State Supreme Court Justice Debra Givens to the maximum sentence of 1 year in local jail.

On Thursday, February 16, 2023, at approximately 11:45 a.m., the defendant was in custody at the Erie County Probation Department office on Niagara Plaza in the City of Buffalo. A warrant had been issued for his arrest for a violation of probation. The defendant became combative with probation officers while inside a secure hallway of the building and continued to fight with officers as he was escorted out of the building onto Pearl Street. The defendant caused physical injury to a probation supervisor. The incident was captured on surveillance video.

Judge Givens reserved her decision following a three-day, non-jury trial in mid-September 2024. On October 23, 2024, Judge Givens rendered her decision, finding Davis guilty of one count of Assault in the Third Degree (Class “A” misdemeanor).

Acting DA Keane commends the Erie County Probation Department for their work in this investigation.

The case was prosecuted by Assistant District Attorney Mitchell T. Schoellkopf of the Vehicular Crimes Bureau.
