The incident occurred in the early hours of July 4, 2024, on the 1400 block of East Delavan Avenue near Edison Avenue. Prosecutors say Mitchell fired a shot from an illegal handgun, striking a 31-year-old male victim. The victim was transported to ECMC in a private vehicle and required multiple surgeries for serious abdominal injuries.

Buffalo Police recovered a handgun and a loaded extended magazine in a nearby garbage tote. Mitchell, who was on parole at the time, was arrested on July 12, 2024, and arraigned the following day, where he was ordered held without bail.

Mitchell faces a maximum sentence of 25 years in prison as a second violent felony offender. Sentencing is scheduled for April 14, 2025, before Erie County Court Judge Susan Eagan.

Erie County District Attorney Michael J. Keane commended members of the Buffalo Police Department for their investigative efforts. The case was prosecuted by Assistant District Attorneys Ryan M. Flaherty and Megan A. Connelly.
