(WNY News Now) – BUFFALO, NY – A 25-year-old native of Guatemala, Gendry Amilcar Niz-Niz, has been arrested and charged with making a false statement, U.S. Attorney Michael DiGiacomo announced. The charge carries a maximum penalty of five years in prison and a $250,000 fine.

According to a criminal complaint, Niz-Niz was stopped on March 16, 2025, at approximately 4:30 p.m. on Main Street in Lockport for multiple vehicle and traffic violations. The Lockport Police Department requested assistance from U.S. Border Patrol after Niz-Niz provided a foreign identification document. The ID card, appearing to be from the Republic of Guatemala’s Department of Transportation, bore the name Juan Martinez-Chavez.

When questioned by a Border Patrol agent, Niz-Niz identified himself as “Juan Martinez.” A records check using the provided name and date of birth showed no legal entry documentation into the United States. Niz-Niz later admitted to entering the U.S. illegally and stated it was his first encounter with immigration authorities. However, further investigation revealed that he had previously been arrested under the name Gendry Amilcar Niz-Niz in Tucson, Arizona, in November 2021.

The Lockport Police Department and U.S. Border Patrol conducted the investigation, led by Chief Steven Abbott and Patrol Agent-in-Charge Martin B. Coombs.

A criminal charge is an allegation, and the defendant is presumed innocent until proven guilty in a court of law.
