(WNY News Now) – A 40-year-old man was arrested by the Cattaraugus County Sheriff’s Office after entering a Walmart he had been banned from in 2023.

OLEAN, N.Y. — The Cattaraugus County Sheriff’s Office arrested Timothy R. Kiernan, 40, on Monday afternoon for criminal trespass in the third degree.

Deputies responded to a call at 1 Leo Moss Drive in Olean at approximately 1:32 p.m. on May 12. Upon arrival, officers determined that Kiernan had entered the store despite being previously banned from the property in 2023.

Kiernan was taken into custody without incident and charged with criminal trespass in the third degree, a misdemeanor under New York State law.

Following processing, Kiernan was released on an appearance ticket and is scheduled to appear in court at a later date. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
