(WNY News Now) – DUNKIRK, N.Y. – A Dunkirk man was taken into custody on May 31 after attempting to evade arrest by providing a false identity during a warrant check.

At approximately 5:23 p.m., Dunkirk Police officers encountered a male subject near East 7th Street and Columbus Avenue who was confirmed to have an active probation warrant issued by the Chautauqua County Sheriff’s Office. The warrant was related to a charge of Rape in the 3rd degree.

The individual, identified as 21-year-old Jocef A. Laboy of Dunkirk, allegedly misled officers by repeatedly providing another person’s name. After further investigation, officers were able to confirm Laboy’s true identity.

Laboy was arrested and charged with Criminal Impersonation in the Second Degree, a misdemeanor offense under New York Penal Law §190.25(1). Following his arrest, he was transferred to the custody of the Chautauqua County Sheriff’s Office to address the outstanding warrant. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
