Police assist CPS in condemning West Side residence; one adult arrested, charges pending for second

(WNY News Now) – Jamestown, NY – A 27-year-old Jamestown man was taken into custody Friday morning after police and child protection officials found three young children living in hazardous conditions at a residence on the city’s west side.

On July 11, 2025, at approximately 9:17 a.m., officers from the Jamestown Police Department’s First Platoon responded to assist Child Protective Services (CPS) and the Department of Development at a residence in Jamestown. Authorities entered the home and encountered Max Hubbard, 27, and Breanne Fuller, 24, both residents of Jamestown, along with three children—ages 5, 3, and 1.

According to police, officers observed deplorable and unsafe living conditions inside the residence. As a result, the Department of Development condemned the property. CPS removed the children and took custody of the mother. Hubbard was arrested at the scene and charged with Criminal Contempt in the Second Degree and Endangering the Welfare of a Child.

Investigators say the children were protected under a restraining order issued after a similar incident last summer involving both Hubbard and Fuller. Fuller is expected to face the same charges at a later date.

Hubbard was transported to the Jamestown City Jail and is being held pending arraignment in Jamestown City Court. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
