(WNY News Now) – A 78-year-old man from Pepper Pike, Ohio, was arrested in the Town of Ellery after allegedly striking another person with a plastic baseball bat.

ELLERY, NY – On Thursday, July 24, 2025, at approximately 8:10 p.m., deputies from the Chautauqua County Sheriff’s Office responded to a reported altercation at a residence in the Town of Ellery.

Upon arrival, deputies conducted an investigation and determined that Jim H. Weaver, a 78-year-old male resident of Pepper Pike, Ohio, had allegedly struck another individual with a plastic baseball bat during the incident.

Weaver was arrested at the scene and charged with Harassment in the Second Degree, a violation under New York State law. Following his arrest, Weaver was released on appearance tickets and is scheduled to appear in Town of Ellery Court at a later date. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
