(WNY News Now) – A Brocton man was arrested after allegedly refusing to accept a traffic summons during a midday traffic stop in Westfield on October 3.
WESTFIELD, N.Y. — A 34-year-old Brocton resident, identified as Merritt Wolcott, was taken into custody following a traffic stop conducted by the Westfield Police Department on Oak Street around 12:00 p.m. Friday, October 3.
According to police, the officer initiated the stop after observing Wolcott operating a motor vehicle while using a mobile device, a violation under New York State traffic law. During the encounter, the officer attempted to issue a traffic summons for the infraction, but Wolcott allegedly refused to accept it and demanded that the officer leave him alone.
Police reported that several attempts were made to reason with Wolcott and encourage him to address the matter in court. When he continued to refuse, officers placed him under arrest for Obstructing Governmental Administration in the Second Degree, in addition to the mobile device violation.
Wolcott was later released on appearance tickets and is scheduled to appear in the Town of Westfield Court at a future date. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
