(WNY News Now) – A South Dayton man was charged with driving while intoxicated after deputies conducted a traffic stop in the Town of Hanover on April 18.

According to the Chautauqua County Sheriff’s Office, the incident occurred on April 18, 2026, at approximately 2:22 a.m. in the Town of Hanover.

Deputies reported that they initiated a traffic stop after observing a vehicle fail to stop at a stop sign. The driver was identified as Justin K. Smith, 42, of South Dayton, New York.

Following an investigation, deputies determined that Smith was operating the vehicle while intoxicated. He was subsequently taken into custody and transported to the Chautauqua County Sheriff’s Office for processing.

Smith was charged with Driving While Intoxicated (DWI) and Driving While Intoxicated Per Se. After processing, he was released with appearance tickets and is scheduled to answer the charges in the Town of Hanover Court at a later date. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
