(WNY News Now) – A Jamestown man was charged with reckless vessel operation and operating a boat while impaired by drugs after officers responded to a boater in distress on Chautauqua Lake in Celoron.

Town of Ellicott police responded to a navigation complaint at about 10:01 a.m. Wednesday, September 2, involving a boater who had reportedly entered the water after experiencing trouble with a vessel.

Police identified the boater as Brandon E. Fogle, 43, of Jamestown. According to police, Fogle was allegedly operating the vessel recklessly before jumping into Chautauqua Lake after he was unable to get the boat started.

Fogle was assisted out of the water. Following an investigation, officers determined that he was allegedly under the influence of a drug, police said.

Fogle was charged with Reckless Operation under the Navigation Law and Operating a Vessel While Ability Impaired by Drugs.

Police said Fogle was released with traffic tickets. He is scheduled to appear in Town of Ellicott Court at a later date to answer the charges.

The charges are allegations, and Fogle is presumed innocent unless proven guilty in court.
