(WNY News Now) – A Jamestown Police Department investigation into the December 2025 stabbing of Nicholas S. Attalla aka Nicky Sal at a Tim Hortons has resulted in additional charges against Attalla and two others, including allegations that a child and other customers were placed in danger during the confrontation.

Jamestown police have announced additional charges stemming from a fight and stabbing reported at the Tim Hortons at 10 S. Main St. on December 13, 2025.

Officers responded to the business at about 12:30 p.m. after receiving a report of a stabbing. During the initial investigation, James T. Morris, 43, of Jamestown, was charged with first-degree assault, third-degree criminal possession of a weapon and tampering with physical evidence in connection with the stabbing of Nicholas S. Attalla aka Nicky Sal, 42, of Erie, Pennsylvania.

Police said the investigation continued through witness interviews, video review and a search warrant involving a cellular phone.

According to investigators, Attalla had been communicating through a dating site with a person who identified themselves as a 16-year-old male. Police said Attalla was portraying himself as a 14-year-old girl during the communications. The two later agreed to meet at the Tim Hortons.

Investigators said Attalla entered the business and confronted Morris and Eric R. Spencer, 42, of Jamestown, accusing Morris of attempting to meet a 14-year-old girl. Police said a review of phone records found no communication between Attalla, Morris or Spencer before the confrontation.

A physical altercation then broke out, according to police. Investigators said several customers were placed in danger during the fight, including a one-year-old child. Police said the altercation spilled into the area where the child and the child’s family were located.

As the investigation continued, police filed additional charges.

Morris was charged with second-degree criminal nuisance and endangering the welfare of a child, in addition to his original charges.

Spencer was charged with second-degree criminal nuisance and endangering the welfare of a child.

Attalla turned himself in to the Jamestown Police Department on September 4, 2026. He was charged with third-degree assault, second-degree criminal nuisance and endangering the welfare of a child.

Police said Morris and Spencer were both arrested in January 2026.

All charges are allegations, and the defendants are presumed innocent unless proven guilty in court.
