(WNY News Now) – A 45-year-old Little Valley man was arrested on felony DWI charges after Cattaraugus County sheriff’s deputies responded to a report of an erratic driver on Route 353.

According to the Cattaraugus County Sheriff’s Office, Joseph L. Phillips was taken into custody at about 7:13 p.m. Tuesday, Sept. 22, following a traffic stop in the Town of Little Valley.

Deputies said they received a complaint about an erratic operator traveling on Route 353. They located the vehicle and conducted a traffic stop near 5442 Route 353.

Following an investigation, deputies determined Phillips was allegedly driving while intoxicated, according to the sheriff’s office.

Phillips was transported to the Cattaraugus County Sheriff’s Office for processing and a chemical test.

He was charged with Driving While Intoxicated with a Previous Conviction Within 10 Years and Aggravated DWI with a Blood Alcohol Content of .18% or More and a Prior Conviction Within 10 Years.

Phillips was released with an appearance ticket and is scheduled to appear in Little Valley Town Court at a later date. The charges are allegations, and Phillips is presumed innocent unless proven guilty in court.
