Family Of Man Killed In Landfill Accident Suing Chautauqua County

ELLERY – The family of a man killed in an accident at Chautauqua County’s landfill last year have filed a lawsuit against the County Government.

The suit, filed in Chautauqua County State Supreme Court, is seeking financial damages in the death of 56-year old Scott Deming Sr.

The Westfield resident died in August after he was run over by a bulldozer pushing a large pile of garbage that Deming was standing behind.

The County Sheriff’s Office says he worked for an independent commercial business that was using the county’s facilities.

His family’s attorney says the County is negligent for not ensuring the landfill was a safe place to work.

Furthermore, the suit claims the County was not in compliance with safety laws.

The Chautauqua County Landfill, County Department of Public Facilities and Chautauqua County Government have all been named in the legal action.
