MAYVILLE – A lawsuit has been filed to prevent the Chautauqua Lake Pops concert series from taking place this summer in the Village of Mayville.

The suit was filed last week in Chautauqua County Supreme Court.

Plaintiffs from Mayville, Dewittville and Ohio accuse the Bemus Bay Pops, Dan Dalpra and the Village of Mayville of attempting to operate without proper environmental permits.

They claim the summer concert events create excessive levels of noise that disturbed the peace.

Legal documents contain a letter from the New York State Department of Environmental Conservation that report a permit was denied after the agency found the floating stage, and attached docks, were not in line with the Local Waterfront Revitalization Plan.

The concert series is slated to kick off Saturday, July 10 at Lakeside Park in Mayville.
