The federal lawsuit was filed Monday by ‘Every-town Law’ on behalf of Elihana’s mother, Sandra Torres, and three siblings.
It alleges the mass shooting was “enabled by the illegal, reckless, and negligent actions of” gun manufacturer Daniel Defense.
The lawsuit also names oasis outback, the store where it says the shooter “picked up or bought” guns and ammunition, including two AR-style rifles.
According to the suit, the store had a duty not to sell weapons to the shooter, who it knew or should have known was likely to harm himself or others.”
The store said they have no comment on the lawsuit, which also details a failed law enforcement response by school district, city, county, and state officials.
