DUNKIRK, NY (May 21, 2024) – A domestic dispute on W Howard Ave led to the arrest of Josean Gutierrez, 36, of Dunkirk. Gutierrez faces multiple charges, including reckless endangerment and unlawful imprisonment.
On Tuesday night at approximately 10:11 PM, Dunkirk Police responded to a call about a domestic dispute. The female victim had fled to a neighbor’s house. Upon arrival, officers heard noises of destruction from the victim’s residence. Gutierrez emerged from the house wielding a large machete and threatened to shoot the officers. He then got into a vehicle in an attempt to flee, nearly striking a police car.
A standoff ensued, with Gutierrez refusing to comply with police commands and continuing his threats. After failed negotiations, officers forcefully removed Gutierrez from the vehicle. He resisted arrest but was ultimately subdued and taken into custody.
Gutierrez was charged with obstructing governmental administration, resisting arrest, two counts of reckless endangerment, unlawful imprisonment, criminal mischief, and harassment. He was arraigned in Dunkirk City Court and released on his own recognizance.
