(WNY News Now) – Buffalo, NY – A jury has convicted Sergio J. Brooks, 38, of stealing from a building under construction, Erie County Acting District Attorney Michael J. Keane announced. Brooks was found guilty of third-degree burglary and fourth-degree grand larceny following a swift trial and jury deliberation.
Brooks was accused of entering a construction site at Best Street and Michigan Avenue around 3:45 a.m. on February 16, 2023. The prosecution presented evidence that Brooks took various items, including pipes, circuit breakers, valves, and copper materials. Buffalo police were alerted by a security system and found Brooks nearby with two bags filled with the stolen items. After a brief chase, he was taken into custody.
Following the one-day trial, the jury deliberated for less than four hours before reaching a verdict. Brooks was convicted of third-degree burglary, a Class D felony, and fourth-degree grand larceny, a Class E felony.
Brooks is currently being held without bail and is scheduled for sentencing on August 23. He faces a maximum sentence of seven years in prison.
