(WNY News Now) – BUFFALO, NY – The U.S. Attorney’s Office announced a settlement with Community Bank, N.A. (CBNA) over allegations that it violated the Americans with Disabilities Act (ADA) by denying American Sign Language (ASL) interpreters to customers at its Orchard Park, NY branch.
The complaints involved two deaf customers who requested ASL interpreters for real estate transactions. In January 2021, CBNA offered to pay half the cost for an interpreter, and in October 2023, it refused to cover any costs. Both customers experienced significant stress securing interpreters independently.
Under the settlement, CBNA will ensure non-discriminatory practices and effective communication for all customers, including those who are deaf or hard of hearing. CBNA agreed to implement an ADA Effective Communications Policy, prominently displayed in branches and online, train all customer-facing employees, and compensate each complainant with $1,000.
CBNA also committed to providing necessary auxiliary aids and services free of charge, responding promptly to such requests, and not requiring customers to bring their own interpreters. The DOJ emphasizes its commitment to ensuring equal opportunities and effective communication for individuals with disabilities.
