(WNY News Now) – Buffalo – A Niagara Falls father and son are facing serious federal charges following a joint investigation by the ATF and local law enforcement, revealing alleged firearms trafficking and illegal machine gun transfers.

U.S. Attorney Trini E. Ross announced the arrest of Dustin McCarthy, Sr., 43, and his son, Dayzon McCarthy, 21, both of Niagara Falls, NY, on federal gun charges. The father-son duo faces significant prison time, with charges ranging from firearms trafficking to the illegal transfer of a machine gun.

The arrests follow an extensive investigation by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) and the Niagara County Sheriff’s Office. Authorities conducted four controlled purchases of firearms from Dayzon McCarthy between June 20 and August 12, 2024. The firearms included a Glock .22 caliber pistol, a Beretta, a .380 caliber pistol, and a firearm fitted with a 3D-printed auto sear, converting it into a machine gun. Dayzon McCarthy, who has a prior felony weapons conviction, is accused of trafficking these illegal weapons.

On July 23, 2024, investigators also executed a controlled purchase of a 9mm pistol from Dustin McCarthy. Despite being under pre-trial supervision for federal narcotics trafficking charges and having two prior felony convictions, Dustin allegedly continued to engage in illegal firearms activities.

The McCarthys appeared before U.S. Magistrate Judge Michael J. Roemer this afternoon. Both were held pending a detention hearing scheduled for August 21, 2024.

This case, a collaboration between the ATF, Niagara County Sheriff’s Office, and Niagara Falls Police Department, underscores the ongoing efforts to combat illegal firearms trafficking in the region.









The charges are accusations at this stage, and both defendants are presumed innocent unless proven guilty in a court of law.
