(WNY News Now) – Franklinville – An 80-year-old Franklinville resident is facing criminal charges after a dispute over property lines led to the destruction of several trees.

Franklin D. Waite, 80, of Franklinville, New York, was arrested on August 20, 2024, for criminal mischief in the fourth degree following an investigation into property damage on Lyndon Road. According to the Cattaraugus County Sheriff’s Office, Waite allegedly pulled five trees out of the ground on his neighbor’s property during an early morning dispute.

The incident occurred at approximately 4:32 AM at 2208 Lyndon Road, where Waite reportedly took matters into his own hands, resulting in the damage of the neighbor’s trees. Upon being informed of the incident, local authorities conducted an investigation which led to Waite’s arrest.

After being processed, Waite was released on an appearance ticket and is scheduled to appear in Franklinville Town Court at a later date. As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
