(WNY News Now) – Buffalo – A Getzville man has been sentenced to probation after defrauding a victim of her life savings, totaling $450,000, over a four-year period.

Victor P. Marinaccio, 66, of Getzville, was sentenced to five years of probation by State Supreme Court Justice Paul B. Wojtaszek. Acting Erie County District Attorney Michael J. Keane announced the sentencing today following Marinaccio’s guilty plea to Grand Larceny in the Second Degree (Class “C” felony).
Between July 2018 and August 2022, Marinaccio deceived a victim from Amherst, misrepresenting himself and gaining her trust in order to fraudulently obtain $450,000 of her life savings, which he spent on travel and personal expenses. Marinaccio used the victim’s credit cards and conducted wire transfers to steal the money.
After being indicted, Marinaccio fled New York and was found by the United States Secret Service living in a Las Vegas hotel. In September 2022, he waived extradition and returned to Western New York for prosecution. In May 2024, he pleaded guilty to the single count in the indictment and agreed to pay $250,000 in upfront restitution at his sentencing.
As part of the sentencing, Marinaccio also signed a Confession of Judgment, committing to pay an additional $200,000 to the victim. A final order of protection was issued on behalf of the victim and her family, remaining in effect until September 2032.
Assistant District Attorney Brian P. Dassero of the Special Investigations and Prosecutions Bureau handled the case, with Acting DA Keane commending the U.S. Secret Service for their role in tracking down the defendant.
