(WNY News Now) – A Rochester man has been sentenced to five years in state prison following his conviction for attempted criminal possession of a weapon after a routine traffic stop led to the discovery of a loaded firearm.
Dan Crisoptimo Baez, 33, of Rochester, was sentenced on Monday, September 30th, to five years in state prison with an additional five years of post-release supervision. The sentence follows his conviction for Attempted Criminal Possession of a Weapon in the Second Degree, a class D violent felony.
The case originated in March when New York State Police conducted a traffic stop in the Town of Portland. During a search of Baez’s vehicle, troopers discovered a loaded 9mm pistol, leading to his arrest and initial charges of Criminal Possession of a Weapon in the Second Degree, a class C violent felony.
In July, Baez pled guilty to a reduced charge and was sentenced as a predicate felon due to having multiple felony convictions within the past decade. At the time of the arrest, Baez was also on New York State parole, further complicating his legal situation.
Chautauqua County District Attorney Jason Schmidt expressed gratitude to the New York State Police for their efforts in the case, which was prosecuted by Assistant District Attorney Erik Bentley.
