(WNY News Now) – A routine call for a vehicle off the road led to the arrest of a Hamburg man on DWI charges in the Town of Dayton.

DAYTON, NY – Sheriff Eric A. Butler reported that deputies responded to an accident on Route 62 in the Town of Dayton at approximately 5:40 p.m. on December 14, 2024, involving a truck that veered off the roadway into a ditch. Upon arrival, deputies identified the driver as Daniel J. Wutz, 62, of Hamburg, NY.

Wutz exhibited signs of intoxication, prompting deputies to initiate field sobriety tests, which Wutz refused to perform. However, he did comply with a chemical breath test, revealing a blood alcohol concentration (BAC) above the legal limit.

Wutz was charged with violations under New York Vehicle and Traffic Law (VTL), including:

  • VTL 1192(2): Driving while intoxicated per se (BAC over legal limit).
  • VTL 1192(3): Driving while intoxicated (common law).
  • VTL 1128(a): Failure to stay in a single lane.

The suspect was issued an appearance ticket and is scheduled to appear in the Town of Dayton Court at a later date. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
