(WNY News Now) – NEW ALBION, N.Y. – A New Albion man was arrested for illegal firearm possession following an investigation into a reported burglary with shots fired earlier this month.

According to Sheriff Eric A. Butler, deputies responded to an incident on January 4, 2025, in the Town of New Albion after receiving reports of a possible burglary involving gunfire. Upon arrival, patrols found no signs of a burglary or any victims at the scene.

During the investigation, deputies identified 54-year-old James S. Marshall in possession of a .270 long gun. A background check revealed that Marshall has a prior felony conviction, prohibiting him from legally possessing firearms.

Marshall was taken into custody, processed, and released with an appearance ticket. He is scheduled to appear in New Albion Town Court at a later date. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
