(WNY News Now) – ALLEGANY, NY – A traffic stop in the Village of Allegany early Tuesday morning led to the arrest of a local man on charges of driving while intoxicated.

According to the Cattaraugus County Sheriff’s Office, deputies pulled over Justice Barth, 28, at approximately 1:15 a.m. on February 25, 2025, after he allegedly failed to stop at a stop sign. During the stop, deputies determined Barth was operating the vehicle while intoxicated. He was subsequently charged with Driving While Intoxicated (DWI) with a Blood Alcohol Content (BAC) greater than 0.08%, Driving While Intoxicated Per Se, and Failure to Stop at a Stop Sign.

Barth was taken into custody, processed, and later released with an appearance ticket for a future court date. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
