(WNY News Now) – Police arrested a 35-year-old Jamestown resident early Tuesday morning for unlawfully entering a South Side apartment.

JAMESTOWN – A city resident is facing criminal charges following a trespass incident on Jamestown’s South Side in the early hours of Tuesday, June 3.

At approximately 4:00 a.m., officers from the Jamestown Police Department’s 3rd Platoon responded to a trespass complaint at a residential building. Upon arrival, officers located Marcus A. Mcaffee, 35, inside an apartment unit. According to police, Mcaffee had been previously arrested at the same property earlier in the shift and was not permitted to be on the premises.

Investigators say Mcaffee entered the apartment while the occupant was asleep. Officers took him into custody without incident and transported him to the Jamestown City Jail.

Mcaffee has been charged with Criminal Trespass in the Second Degree. He is being held pending arraignment in Jamestown City Court. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
