(WNY News Now) – BUFFALO, N.Y. — David Pena-Batista, 21, of Buffalo, was arrested and charged with two counts of distribution of oxycodone, according to U.S. Attorney Michael DiGiacomo. Each count carries a maximum penalty of 20 years in prison and a $1 million fine.
The charges stem from an investigation that began in January 2024, conducted by the FBI Buffalo Safe Streets Task Force and the New York State Police. Authorities identified Pena-Batista as involved in criminal activity on Buffalo’s west side after multiple controlled purchases of oxycodone were made from him during the inquiry.
Pena-Batista appeared before U.S. Magistrate Judge Jeremiah J. McCarthy and was held pending a detention hearing.
The investigation was led by the FBI, under Acting Special Agent-in-Charge Mark Grimm, and the New York State Police, directed by Major Amie Feroleto. Assistant U.S. Attorneys Jeffrey E. Intravatola, Joshua A. Violanti, and Louis A. Testani are prosecuting the case.
As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
