(WNY News Now) – A 35-year-old Dunkirk man is facing multiple charges after allegedly breaking into a residence, assaulting a woman, and damaging police property.

DUNKIRK, N.Y. – On Saturday, June 28, 2025, at approximately 12:06 a.m., Dunkirk Police responded to a reported burglary in progress at a residence on East 7th Street. Officers were informed that a male suspect had forcibly entered the home and assaulted a female occupant before fleeing the scene on a bicycle.

Responding officers located and apprehended the suspect, identified as Santos M. Almestica, 35, of Dunkirk. Authorities say Almestica resisted arrest, attempted to kick out the windows of the patrol vehicle, and continued to act disorderly at police headquarters. During the booking process, he allegedly shattered a door window at the station.

An investigation revealed that Almestica had damaged the front door of the victim’s home during forced entry. He then allegedly assaulted the victim, despite an active court order directing him to stay away from her and the residence.

Almestica was charged with the following offenses:

  • Burglary in the Second Degree (PL 140.25[2])
  • Criminal Contempt in the First Degree (PL 215.51[B])
  • Three counts of Criminal Mischief in the Fourth Degree (PL 145.00[1])
  • Harassment in the Second Degree (PL 240.26[1])

He was arraigned and remanded to Chautauqua County Jail on $50,000 bail. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
