Traffic stop leads to arrest after protected party found in vehicle with subject in violation of court order.
WESTFIELD, N.Y. — A routine traffic stop on East Main Street in the Village of Westfield led to the arrest of a local man for criminal contempt on the morning of July 9, 2025.
At approximately 9:47 a.m., officers from the Village of Westfield Police Department initiated a stop on a vehicle traveling eastbound after observing smoke coming from the front passenger-side tire. The stop was made out of concern for the safety of the driver, passengers, and other motorists.
During the investigation, police identified the driver as 41-year-old Xovier Nieves of Westfield. Authorities discovered that Nieves was the respondent in an active Order of Protection. The protected party named in the order was found inside the vehicle at the time of the stop, resulting in a violation of the court order.

Nieves was taken into custody without incident and transported to the Westfield Police Department for processing. He was later transferred to the Chautauqua County Jail for arraignment at the Centralized Arraignment Part (CAP).
He is charged with Criminal Contempt in the Second Degree under New York Penal Law § 215.50(3). Nieves is scheduled to appear in the Town of Westfield Court at a later date to respond to the charge. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
