(WNY News Now) – A 23-year-old man was charged with driving while intoxicated after deputies found him asleep behind the wheel of a running vehicle in the Town of Humphrey.

HUMPHREY, NY – The Cattaraugus County Sheriff’s Office reports that Matthew D. Murphy, 23, of Lake View, NY, was arrested in the early morning hours of Saturday, July 12, 2025, following a suspicious vehicle complaint on Five Mile Road in the Town of Humphrey.

Deputies responded to the scene at approximately 1:05 a.m. and located Murphy asleep in the driver’s seat of a running vehicle. After conducting an investigation, officers determined Murphy was allegedly operating the vehicle while intoxicated.

Murphy was transported to the New York State Police Olean Barracks for a chemical breath test, which he refused. He was then taken to the Cattaraugus County Sheriff’s Office Substation in Olean for processing.

Following a preliminary refusal hearing at the Town of Ellicottville Court, Murphy was released on his own recognizance. His driver’s license was suspended, and he was issued an appearance ticket.

Murphy is scheduled to appear in the Town of Humphrey Court for further proceedings. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
