(WNY News Now) – Town of Ellicott police arrested Andrew C. Burns, 36, of Depew, early Sunday morning on multiple charges, including DWI and assault, after responding to a domestic dispute.

ELLICOTT, N.Y. — On August 10, 2025, at approximately 2:23 a.m., Town of Ellicott police responded to a welfare check at the intersection of Fluvanna Town Line Road and Moon Road. Officers encountered Andrew C. Burns, 36, of Depew, and a reported victim involved in a domestic incident.

According to police, the victim sustained bruising on their arm, allegedly caused when Burns grabbed and pushed them to the ground. During the investigation, officers determined that Burns was operating a vehicle while intoxicated.

Burns was charged with Reckless Endangerment in the Second Degree, Assault in the Third Degree, Driving While Intoxicated (third offense), and Aggravated Unlicensed Operation in the First Degree. He was taken into custody and transported to the Chautauqua County Jail for centralized arraignment.

Burns is scheduled to appear in Town of Ellicott Court at a later date to answer the charges. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
