(WNY News Now) – A 45-year-old Coldspring man is facing multiple charges after Cattaraugus County Sheriff’s deputies investigated an ATV rollover involving a young child on the Seneca Nation Allegany Territory.

COLDSPRING, N.Y. — The Cattaraugus County Sheriff’s Office reports that Virgil L. Wolfe, 45, of Coldspring, was arrested following an investigation into an ATV rollover on Saturday, July 25.

According to the Sheriff’s Office, deputies assigned to the Seneca Nation Allegany Territory responded at approximately 8:17 p.m. to the intersection of West Perimeter Road and Old Route 17 for a report of an ATV rollover involving a small child who was not wearing a helmet.

Deputies later located the ATV, the driver, and the child at a residence on West Perimeter Road in the Town of Coldspring. Following an investigation, authorities allege that Wolfe was operating the ATV while intoxicated.

Investigators said Wolfe was taken to the Cattaraugus County Sheriff’s Office for processing, where he allegedly refused to provide a chemical test sample.

Wolfe was released with an appearance ticket and multiple uniform traffic tickets. He is charged with Endangering the Welfare of a Child, Leandra’s Law Driving While Intoxicated, Driving While Intoxicated, first-degree Aggravated Unlicensed Operation, Unlicensed Operator, Operating an Unregistered ATV, Unlawfully Operating an ATV on a Highway, Operating an ATV Without Insurance, No Helmet While Operating an ATV, Unsafe Tires on an ATV, and Refusal to Take a Breath Test.

He is scheduled to appear in the Town of Coldspring Court at a later date to answer the charges. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
