(WNY News Now) – A 38-year-old Franklinville man was charged with fourth-degree criminal mischief following an incident at Walmart in the Town of Allegany, according to the Cattaraugus County Sheriff’s Office.

Eric J. Halbert was taken into custody by Cattaraugus County Sheriff’s Office deputies at about 7:03 p.m. Saturday, Aug. 22, in the Town of Franklinville.

Deputies charged Halbert with criminal mischief in the fourth degree in connection with an incident that occurred at Walmart in the Town of Allegany.

After processing, Halbert was released on an appearance ticket. He is scheduled to return to Allegany Town Court at a later date for arraignment.

The charge is an allegation, and Halbert is presumed innocent unless proven guilty in court.
