(WNY News Now) – A 66-year-old former Rochester resident has been indicted on a federal arson charge in connection with a 2004 fire that killed one person at a rental property in Rochester, federal prosecutors announced.
BUFFALO, N.Y. — Timothy Kuhn, 66, of Pensacola, Florida, faces a federal charge of arson involving property used in interstate commerce resulting in death, following an indictment returned by a federal grand jury.
According to the indictment, Kuhn allegedly set fire to a rental property at 17 Yates Street in Rochester on Feb. 28, 2004. The fire resulted in the death of an individual identified in court documents as S.S.
The charge carries a maximum potential sentence of life in prison if Kuhn is convicted.
Kuhn was arraigned in federal court in the Northern District of Florida and ordered detained, according to U.S. Attorney Michael DiGiacomo. He is expected to be returned to the Western District of New York at a later date to face the charge.
Assistant U.S. Attorney Melissa M. Marangola is prosecuting the case.
The investigation involved the Rochester Police Department, led by Chief David Smith, and the Bureau of Alcohol, Tobacco, Firearms and Explosives, under the direction of Special Agent-in-Charge Bryan DiGirolamo of the agency’s New York Field Division.
The indictment represents a formal accusation. Kuhn is presumed innocent unless and until proven guilty in court.
