LITTLE VALLEY – A Town of Busti woman who previously plead guilty to second-degree manslaughter in the death of Busti man Wilfredo Colon-Rodriguez, Jr. will be sentenced Monday in Cattaraugus County Court.

Marylou Johnson, as part of the deal, accepted a sentencing commitment of two-to-six years behind bars. Johnson gave up her right to appeal.

A motion by the Cattaraugus County District Attorney’s Office to revoke bail was denied by the judge.

In April 2018, Colon-Rodriguez Jr. was reported missing by a neighbor who became concerned after not speaking with him for several days.

The Lakewood-Busti Police Department then opened a missing persons case. His body was later found on Swanson Hill Road in Randolph.

New York State Police originally charged Johnson in September 2018 with second-degree manslaughter, a class C felony; as well as second-degree vehicular manslaughter, second-degree assault, driving while intoxicated and leaving the scene of an incident without reporting serious physical injury, all class D felonies. Johnson was also indicted by a Cattaraugus County Grand Jury on the charges.

Johnson is scheduled to be sentenced on Sept. 16 at 9:30 a.m. in Cattaraugus County Court.
