Asylum Seeker Arraigned for Assaulting Employee in Town of Cheektowaga


(WNY News Now) – An asylum seeker from Venezuela, was arraigned on Saturday morning before Cheektowaga Town Court Justice John Wanat. He faces charges of Criminal Mischief, Assault, and Harassment following a disturbance in the Town of Cheektowaga.

Cheektowaga – The incident occurred on August 26, 2023, at around 3:25 a.m., when Diaz Carvajal, 28, accompanied by an unidentified individual, allegedly caused intentional damage to a lounge on Dingens Street. The defendant is accused of shattering three windows and doors, incurring approximately $12,000 in damages.

Upon confrontation by a building employee, Diaz Carvajal allegedly assaulted the employee, inflicting injuries. The accused asylum seeker was swiftly apprehended and detained.


Diaz Carvajal’s potential sentence could reach a maximum of 7 years if convicted of the highest charge. He remains in custody with bail set at $50,000 cash, insurance bond, or partially secured surety bond.

Additionally, Diaz Carvajal faces another ongoing case involving shoplifting and possession of burglary tools. The defendant is due to appear before Cheektowaga Town Court Justice David M. Stevens on August 31, 2023, at 9:30 a.m., to address both cases.
