(WNY News Now) -Erie County District Attorney John J. Flynn announced that a 26-year-old resident of Buffalo, pleaded guilty to Attempted Assault in the Second Degree before Erie County Court Judge Suzanne Maxwell Barnes.
Buffalo -Christopher Andino of Buffalo admitted his guilt today for attempting to assault a police officer during an arrest on April 11, 2023. The incident unfolded on Herkimer Street in Buffalo at approximately 1:46 p.m. Andino, who was the subject of a bench warrant, resisted arrest, engaged in physical altercation with officers, and even bit a detective sergeant’s hand.
The bench warrant had been issued for Andino’s failure to appear for a judicial diversion court program after his previous guilty plea for felony burglary in November 2021. On that occasion, Andino unlawfully entered a Grant Street building, stole cash, and various items from local businesses.
Following his arrest for assaulting the police officer, the District Attorney’s office requested Andino’s removal from the diversion program, seeking to impose a sentence on his original plea. Judge Barbara Johnson-Lee set bail at $30,000, and further proceedings are scheduled for Monday, October 23, 2023.
Christopher Andino now faces a maximum sentence of 4 years in prison for the attempted assault, with sentencing scheduled for Tuesday, January 30, 2024.
