(WNY News Now) – In the aftermath of the U.S. Supreme Court’s Bruen decision, Attorney General Letitia James celebrates victory as the New York State Court of Appeals rejects challenges to gun possession charges in six cases.
Albany – New York Attorney General Letitia James issued a statement after her office effectively defended New York’s gun laws in six cases before the State Court of Appeals. These cases involved individuals seeking to overturn charges of illegal weapon possession in the wake of the U.S. Supreme Court’s decision in New York State Rifle & Pistol Association, Inc. v. Bruen.
The Court of Appeals, however, declined to entertain Second Amendment challenges in the cases of David v. New York, Garcia v. New York, Cabrera v. New York, Rivera v. New York, Pastrana v. New York, and Telfair v. New York. Attorney General James emerged victorious in each instance, with the court ruling that the plaintiffs’ Second Amendment claims had not been presented in the lower courts, rendering them ineligible for appellate consideration.
“Gun safety laws protect New Yorkers and are commonsense tools in the fight against gun violence. Individuals who illegally possess a weapon are a threat to our communities and should be held accountable for the harm they pose. My office will always stand up to protect New Yorkers and defend the gun safety laws designed to keep firearms out of the hands of dangerous individuals.”
The decisions mark a significant legal outcome, affirming the state’s authority to regulate gun possession within the bounds of existing laws. Attorney General James emphasized the court’s rulings as a testament to the robustness of New York’s legal framework surrounding firearms, even in the face of recent high-profile Supreme Court decisions.
