(WNY News Now) – A Perry, New York, man faces multiple charges, including Criminally Negligent Homicide, following allegations of supplying a narcotic drug that led to a fatal overdose.

Wyoming County, NY – A Wyoming County Grand Jury has indicted Todd A. Weigert, 28, on charges that encompass Criminally Negligent Homicide, Criminal Possession of a Controlled Substance in the Third Degree, Criminally Using Drug Paraphernalia in the Second Degree, and Criminal Possession of a Controlled Substance in the Seventh Degree.

Weigert is accused of criminally negligently providing a narcotic drug to a 34-year-old woman, resulting in her fatal overdose. Additionally, he faces charges of intending to sell controlled substances, possession of drug paraphernalia, and possessing another narcotic drug on a separate occasion.

If convicted, Weigert could face a maximum sentence of 4 years for Criminally Negligent Homicide and up to 12 years for Criminal Possession of a Controlled Substance in the Third Degree.

Weigert was arraigned before Honorable Keith Kibler on December 21, 2023, where bail was set at $15,000 Cash, $30,000 Bond, and $45,000 partially secured. The pre-trial motion arguments are scheduled for February 15, 2024, at 1:30 p.m. in Wyoming County Court.

The investigation, led by the Perry Police Department and the New York State Police, is being prosecuted by First Assistant District Attorney Vincent A. Hemming. The defense is represented by Leah Nowotarski, Esq.
