(WNY News Now) – Mayville, NY – A 25-year-old man from Bronx, NY, received a 1.5 to 3-year state prison sentence today, April 25th, for Attempted Assault in the 2nd Degree, following his conviction for injuring a correctional officer while serving a previous sentence at Lakeview Correctional Facility.
Garry Pinkney, age 25 of Bronx, NY, was sentenced this morning, April 25th, by Judge David W. Foley to 1.5 to 3 years in state prison after he was convicted of Attempted Assault in the 2nd Degree, a class E felony. While serving a state prison term on a 2018 conviction at Lakeview Correctional Facility, Mr. Pinkney attached and injured a correctional officer. This sentence is to be added to Mr. Pinkney’s current state prison term. He was also sentenced as a predicate felon as this is Mr. Pinkney’s second felony conviction within ten years. The DA would like to thank the Corrections Officer and staff at Lakeview Correctional Facility for their assistance in prosecuting this case and the NY State Police for their work on the investigation.
The DA stated, “An assault on any person is bad enough, but any attack on the men and women who serve our community and put themselves in harm’s way to protect the rest of us is terrible and egregious. I hope this conviction sends a message to the community that these types of crimes will not be tolerated in Chautauqua County.” This case was prosecuted by Assistant District Attorney Andrew Molitor.
